Terms of service

1. Scope and seller

These terms and conditions apply to all orders placed by consumers through the online shop less.de with Less GmbH, Hopfenstr. 32, 20359 Hamburg, Germany (Managing Director: Dr. David Scherf, Local court Hamburg, HRB 138122, email: info@less.de, telephone: +49 40 97073954). A consumer is anyone who enters into a legal transaction for purposes that cannot predominantly be attributed to their commercial or self-employed professional activity.

2. Conclusion of contract

The presentation of products in the shop is not a binding offer but an invitation to you to submit an offer yourself. You place the products you want in the shopping cart and go through the checkout. Before submitting, you can check and change your details at any time using the functions of the cart and the checkout. By clicking the button that completes the purchase you submit a binding offer. We confirm receipt of your order immediately by email. We accept your offer within five working days of receiving the order by shipping the goods to you and informing you by email. The contract is concluded with this acceptance. If we do not ship within this period, no contract is concluded and we will refund payments already made without undue delay.

We do not store the contract text in a way that is accessible to you. You receive the order data, these terms and conditions and the information on the right of withdrawal by email with your order confirmation. The contract language is German; in the English-language shop you can also choose English.

3. Prices and shipping costs

All prices shown in the shop are final prices in euros and include statutory value added tax where applicable. Shipping costs and countries of delivery are shown on the page “Shipping and returns” and are displayed during checkout before you submit your order. From the order value stated there, we ship free of charge. For deliveries to countries outside the European Union, country-specific customs duties, taxes or fees may apply, which you bear unless they are already shown during checkout.

4. Payment

You can pay using the payment methods shown during checkout. The purchase price is due upon conclusion of the contract. Depending on the payment method chosen, the amount is charged when the order is placed or when it is shipped. For payment services, their terms apply in addition.

5. Delivery

We ship the goods to the delivery address you provide. The expected delivery time is stated on the page “Shipping and returns”. If individual items are not available, we will inform you without delay; payments already made will then be refunded promptly.

6. Retention of title

The goods remain our property until paid in full.

7. Subscriptions

Subject matter. For certain products we offer a subscription: we deliver the product to you regularly at the rhythm you choose, at the subscription price shown in the shop. Delivery is free of shipping costs.

Conclusion of contract and payment. By ordering the subscription you submit an offer for the first delivery and for further deliveries at the chosen rhythm. The price for each delivery is charged at the time of the respective delivery using the payment method you have stored. If a payment fails, we will inform you and try again; until payment is made, delivery may be suspended. The purchase price remains owed; you will not incur additional costs as a result.

Minimum term and cancellation. The subscription comprises at least two deliveries. After the second delivery you can cancel the subscription at any time; the cancellation applies to all deliveries that have not yet been charged. If you postpone deliveries, the minimum term nevertheless ends no later than two years after the subscription was concluded. You cancel in your customer account, in the section for your subscriptions, using the cancel button, or by email to info@less.de. Your statutory right to terminate the contract for good cause remains unaffected.

Adjusting, postponing, pausing. Before each delivery we remind you by email. You can change the delivery rhythm and delivery date in your customer account or postpone the next delivery.

Withdrawal. For the subscription, you have the statutory right of withdrawal as set out in the information on the right of withdrawal.

8. Right of withdrawal

As a consumer you have a statutory right of withdrawal. The details are set out in our information on the right of withdrawal. You can also declare your withdrawal using the “Vertrag widerrufen” (withdraw from contract) button in the footer of the shop.

9. Statutory guarantee

The statutory law on liability for defects applies. Information on your statutory guarantee rights can be found in the notice “Your legal guarantee rights” in the footer of the shop. Please report defects or transport damage to us as soon as possible at info@less.de, preferably with a photo.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. In the event of slightly negligent breach of essential contractual obligations, i.e. obligations whose fulfilment is necessary for the proper performance of the contract and on which you can regularly rely, our liability is limited to the foreseeable damage typical for this type of contract. In all other respects, liability for slight negligence is excluded. This does not affect your statutory guarantee rights.

12. Applicable law, dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive you of the protection granted by mandatory provisions of the law of the state in which you have your habitual residence. We do not participate in dispute resolution proceedings before a consumer arbitration board.
